Criminal Justice

The criminal sentence should at least take into account the defendant’s background. This will help the jury to determine whether the victim deserves life imprisonment, death, or discover the number of years to be jailed. (Braswell et al., 2017) There are several factors to consider when looking into the life of a criminal. The first one is whether the defender has little or no history of criminal conduct. The judge has to get to the bottom of why the victim committed the crime it being his or her first time. The second is whether the victim was the main suspect of the crime he did help someone. This. (Braswell et al., 2017) Necessary because some people might commit a crime and set up on another individual. The third reason to consider is whether the defendant was under the influence of something like depressed or stressed out for some reason before committing the crime. This is also a key factor to consider because individuals go through a rough time, and since they have no one to ask for help, they opt to commit a crime, for example, stealing. Lastly, the jury may have to consider whether the crime committed was not intended to hurt anyone.

Additionally, not right to consider the crime committed by giving out prison sentences because there might be a lot of reason that led to the victim committing the crime. However, at the same time, a crime remains to be a crime, and that does not mean that the defendant should not be punished. (Pound, 2018) But the kind of sentence will be determined based on the reason for committing a crime. If there’s a criminal record before and the suspect committed the crime intentionally, then the judge might consider giving a long life sentence. Additionally, if there’s a no criminal record before or there are other reasons linked to the prime suspect, then a short life sentence might be given or even bail.

The possibility of a suspect committing a future crime is linked to his background and not the crime committed. This is because if the defendant has a criminal record in the past, then there is a possibility that he will still repeat the same. However, this is just speculation as a person may decide to change. A crime committed is not supposed to be used in judging for future sin as there may be so many reasons that led to the defendant committing the crime. It could be it was a one-time thing, or he was just getting started.
