The United States and the European Constitutions

            The draft of the US constitution was recommended by the delegates to the constitutional convention in September 17, 1787 at Philadelphia (Nau, 2018). However, the representatives established a strategy of a federal government which was strong through its three significant pillars of Executive, Legislature, and the Judiciary. According to Nau (2018), The constitution had a bill of rights with ten amendments that guaranteed freedom of speech and religion. Similarly, the drafting of the EU constitution started based on the new debate on the future of Europe. The law brought together several treaties and agreements (Mancini, 2018). Additionally, it defined the EU powers, as well as where the member states can retain the right of veto. The fundamental Charter of rights in the European Constitution stipulates the freedoms, rights, and principles to the citizens. Both the US Constitution and the EU Constitution are of considerable significance to the government and its citizens despite their profound similarities and the differences.

The Constitution of the United States is different from the European Constitution as it guarantees liberty and life whereas the Charter of fundamental rights and freedoms of European constitution guarantees free health care, the freedom to strike action and affordable housing to the citizens (Cohen & Sabel, 2017). Another difference is that the law of the US is based on controlling state as well as empowering the citizens, whereas the law of the European is based on controlling the people as well as empowering the nation.

Similarities are inherent in both US and EU constitutions where discrimination against people is contrary to the law, but perception is somehow advocated in favor of few individuals (Cohen & Sabel, 2017). Additionally, in both structures, humans’ freedoms and religions are given the priority. Similarly, both documents outline explicitly the future amendment requirements that guide the constitution.

Europeans can be inspired by the US constitution through advises obtained to consider and understand the characteristics of the US constitution. It provides and upholds the legal and political framework that enhances American success (Nau, 2018). However, the European parliament adds additional rights through a constitutional treaty which give more rights and democratic accountability among the citizens. As per Nau (2018), the European founding document is practical as it frames the governmental institutions as well as establishing who exercises the authority and power of the state. The US constitution is better than the EU constitution because it has had an international influence on the structures which have come later and its impacts on legal thinking.
