LITERATURE REVIEW

Corruption is well defined as the way of criminal offense and dishonesty by an organization or an individual who is charged with the responsibility of authority to gain access to illicit benefits or even the abuse of authority and power bestowed upon them for someone’s private gain (Tatham, 2013). Judicial corruption is attached to the misconduct of judges, who engage in improper sentencing of criminals who have been convicted, bribes, biasness in the judgment, and subsequently hearing of cases and malpractices of the like nature (Tatham, 2013).

The two primary forms of corruption within the federal judicial system are bribery and political interferences. Political interference happens when the member of the executive branch, a politician, or the legislative get caught up in the judicial matters or forms an alliance with judges in fraud schemes (Stevens, 2005). A loose judiciary can be employed by those within the power to bring forth protection for and aid in the legitimacy of fraudulent actions. There is also a high chance of the judiciary forming a force together with politicians in various white-collar crimes, for instance, embezzlement, extortion and, embezzlement (Stevens, 2005). Mohamed Nasheed, who is the former president of the Maldives, termed the judiciary as “the most corrupt institution in the country” (Stevens, 2005). This is by the fact that the executive arm of government employed the judiciary as a tool to intimidate rivals and opponents with politically-motivated issues.
