Broken Constitution
The constitution of the United States is seen as a broken constitution in many ways. One reason many people see it as broken is because of its lack of democracy. The constitution of the United States of America never allowed women to vote. As per freedom, everybody should be allowed to vote for any leader of their choice. This was biased as the women were led by people they did not vote. The constitution was, therefore, undemocratic because it violated the right of the women to vote. Although this was removed in the amendment of the constitution, it is still undemocratic in the way of voting. This is because the constitution was made in a process that lacked democracy, and it has several barriers to achieving democracy. In the US elections, the voting is done by the Electoral College. This is an undemocratic process since it allows the candidates who did not win more votes to win. These flaws show that the constitution is undemocratic, and therefore people see it as a broken constitution.
The constitution’s biggest flaw that made people see it as broken was because the constitution supported slavery (Pham, p45). This proved to be a broken constitution to the critics because it allowed for the continuation of slavery in the United States despite it being unlawful. Slavery is a crime against humanity because it caused suffering to the people, but the constitution continued support to ensure continued support from the states. The amendments that were made in the constitution of the United States still allowed slavery and was only abolished by the civil war. This, therefore, made many people see the constitution as broken. The constitution of the United States is seen as a broken constitution since it was tough to amend the document. This is because the amendment required all the states to agree on the proposal to change. This was impossible since all the states had a rivalry between them, therefore hard to come to an understanding. This is a broken way to amend the constitution of the country. This is because it should depend on the opinion of the people through the legislature. This method considered the states better than than the democratic rights of the people since they had no right to amend the constitution. This system delayed the amendment of the constitution; hence the problems of slavery and lack of democracy continued in the United States.
The constitution was broken since the constitution designed the national government to have fewer powers. The constitutional convention persuaded the central government to surrender its powers under the articles of confederation. This made the national government to be weak and ineffective. The constitution’s flaws are seen by many due to the powers of the judiciary. The judiciary had the authority to declare laws and executive unions unconstitutional. This was meant to weaken the government and make it have limits. This was a broken constitution since the constitution should have the right way of giving powers to different arms of the government. The constitution also should not have any arm of the government have powers over it, but instead, the judiciary should have a duty to apply the laws of the constitution.
In my view, the constitution is broken because, in its function to balance powers among the three branches, it did unfairly. It is therefore supposed to divide the powers between the executive, legislature, and the judiciary in a design that would avoid the tyranny of one branch. However, the constitution of the United States did not balance the powers because the central government was left weak. This, therefore, shows that the constitution failed, and it was broken. The constitution is also inefficient since it gives the judiciary more powers because they have the authority to declare some of the laws unconstitutional. This is also a flaw of the improper division of powers by the constitution since the judiciary has more powers. This may give room for breach or compromise of the laws by the judiciary since they have the powers. This flaw makes the constitution vulnerable and less effective; therefore, it is broken.
The development of the constitution makes have a bad foundation since it was built with barriers preventing democracy. This makes it hard to make the constitution hard to have a democracy for the citizens of the United States. It also makes it hard for citizens to advocate for their democracy because of the complexity of the laws. The acts of lack of democracy, therefore, makes the constitution broken. This is because the constitution did not allow women to exercise their right to vote. It also did not allow the people to vote for their senators, but instead, they were appointed. This is the opposite of what a good constitution does. A proper constitution gives the power to people to freely decide their leaders. The constitution, therefore, breaches the voting rights of the individuals, which makes it a broken constitution.
