Arguments for capital punishment The chosen topic for the discussion is capital punishment. It is the practice of executing people for rectification for committing crime following a proper court proceeding. It is usually used as retribution for severe offences like murder, arson, treason and rape. Capital punishment originated from Ancient Greece, where it was mainly used to punish the offenders under the laws of Draco. Furthermore, it is used in many countries around the globe following the ban of the death penalty. The Amnesty international revealed that use of capital retribution has increased in many countries, thus raising the concern on the morality of the sentence. For instance, Christians have questioned the morality of capital punishment through drawing various biblical verses which prohibits shedding of blood. This essay offers a discussion on the arguments supporting capital retribution and those against the practice. Arguments for capital punishment There is a long debate about the morality of capital punishment and its impact on criminal conduct. The discussion has drawn different opinion where some people support capital punishment while others oppose it. The…
Capital punishment for minors Capital punishment should not be allowed for minors. One of the major factors that explain why minors should be excluded from capital punishment is the fact that past studies have made a conclusion that a minor’s brain is not well developed (ACLU, 2019). What this means is that there is a high likelihood that the child’s judgments will be poor. This is evident from the development stages of human beings. It is clear that at the early stages of life, the decisions of a child will be based on what he/she sees around and not what is considered morally right or legal. Therefore, the teen will tend to make hasty judgments that will lead to offences that may lead to capital punishment. Minors often tend to make poor decisions based on their emotions as well as peer influence. Mostly, teens will make decisions, depending on what the others are doing. This is unlike adults who tend to be quite autonomous in their thinking. Therefore, if a decision is made that the minors should be subjected…
Ruling on State V. Stu Dents In the State v Stu Dent’s case, the number of charges against the accused is extensive, and the craved result of each penalty should fit the crime in question. First, look at the accusations that are being applied to Mr. Dent’s case. The main charge is for the homicide of Uma Opee. He also has charges of assault of a police officer, kidnapping, burglary, and crimes related to drugs. The evidence was piling up against him, and it seemed to be a clear-cut conviction. It appeared that when police apprehended the suspect that he was going to go for the insanity defense. He was acting erratically and ranted about aliens, and claimed he was God at one point. This, in turn, added the assault on a police officer charge when he hit the officer that was detaining him. The accused was found guilty on all counts except for the burglary charge because of the unavailability of proof that the possessions of the victim were grasped minus her knowledge before her death (University of Phoenix…
Is capitalism distinct from slavery or dependent on it? Why does Williams think Smith’s argument is irrelevant to the new world context Introduction Capitalism has gone through various stages of development to be what it is today. With exchange taking place even in the 15th century, transatlantic trade saw the linking of multiple regions through voyages and with the masters of both sea and water being known, including the English and Spaniards (Harvey 67). However, slavery has been linked to industrialization due to its ability to offer free labor and fully utilize individuals who had to be maintained for mass production purposes. In my view, slavery influences capitalism and is much more significant during the early stages of acquiring resources that were later used for re-investment to determine the levels of industrialization amongst nations. First, this paper looks at the nature of slavery and the evolution of capitalism. It then assesses why Adam Smith’s argument with that of Eric Williams. Finally, the paper gives a conclusion on how much capitalism is linked to slavery and would have been much slower…
Why the Death Penalty Should be Abolished Introduction Although the implementation of the death penalty has been a controversial topic over the years, it was reinstated by the landmark ruling by the U.S Supreme Court in 1976 (DPIC, 2019). Since 1976, the number of executed people is around 1500, while around 2700 have been in death rows. According to DPIC (2019), approximately 29 states in the United States are currently practicing capital punishment. While supporters of the death penalty claim that it deters crime and is the best punishment for those who take other peoples’ lives, their arguments lack moral support. With the increasing crime cases, it is clear that the death penalty may not be a pragmatic approach to addressing crime. The death penalty is an outdated method inhibiting fundamental human rights and an uneconomical alternative that should be abolished. Why the Death Penalty Should be Abolished In many scenarios, the decision to use the death penalty as a punishment for an offender follows several court trials. Such trials and proceedings result in high operational costs with no economic…
Unfair Punishments of Victimless Crimes and the Solution of Rehabilitation Instead of Punishments A victimless crime is an unlawful act that either directly or indirectly involves the assassin or the adults because it concurs with nature, and there is no actual victim. For instance, in today’s world, there are those unfair punishments given to people who commit crimes without victims. For example, such punishments may include sanctions such as deprivations of liberty, reprimands, ostracism, fines, the infliction of pain, incarcerations, the death penalty, and amputation. These punishments are unfair in today’s world, and instead of punishing them, they should go through rehabilitation programs. Unfair punishments are given to those who commit crimes without victims As stated above, there are those unfair punishments given to people who commit crimes without victims. Firstly, the sentence of deprivation of liberty is where someone’s freedom is taken away. For example, someone may be deprived of moving from one place to the other through house arrest, especially when the victim is under the strict supervision of crimes committed. The punishment is unfair since it may…
Comparing the Code of Hammurabi and the United States Law The Code of Hammurabi is among the ancient and entirely written legal codes declared by Hammurabi, the Babylonian ruler (about 1772BC). It constituted 282 laws, and it established the standards for trade connections and set fines and punishment to reach the justice requirements. The Code of Hammurabi was imprinted onto a large, finger-like black pillar which was plundered by intruders and later discovered again at around 1901. In general, the Code of Hammurabi was the rule for the ancient Babylonians, just like today’s Americans who look for the Constitution for their regulations. Even though there are thousands of years between the Code of Hammurabi and the U.S laws, there exist similarities and also differences between them. This work examines the ancient Code of Hammurabi, relates it to the U.S. laws, and depicts how they are similar or dissimilar. The Ancient Code of Hammurabi is recognized through its strictness. The first eight laws terminate with the declaration that the transgressor shall be killed. The death penalty is not something new in…
J. W Gamble in the Texas prison This case revolves around J. W Gamble in the Texas prison. Due to an incident at the prison, he suffered substantial back damage. Gamble was given some medicines and sent back to work. However, the back pains did not subsidize, and he rebuffed from going to work, which leads to his punishment by being kept in solitary confinement. In 1974 he signed a pro se complaint alleging that he had been subjected to cruel and unusual punishment in violation of the eighth amendment. Gamble complaint was dismissed for failure to state a claim. The supreme courts reversed, noting that the prison failed to diagnose Gamble by administering an x-ray and that Gamble did not receive any treatment to his back pains. The main questions of the case were whether the pro se complaint raises a constitutional question upon which relief can be granted? Justice Thurgood Marshall wrote the 8-1 decision, the court ruled that the prison treatment to Marshall did not constitute cruel and unusual punishment under the eighth amendment. Justice Stevens dissented.…
