Scenario. What were the key indicators that this behaviour was a violation of workplace
Policy?
According to my case study, the form of sexual harassment that took place included rape and sexual assault. Both of these cases are serious crimes.
Rape is when an individual penetrates another’s vagina mouth or anus with a penis, without consent from the other individual. On the other hand, sexual assault is an act in which a person intentionally sexually touches another person without that person’s consent
The overall definition of sexual assault is an act of physical, psychological and emotional violation in the form of a sexual act inflicted on someone without their permission. It involves either forcing or manipulating an individual to witness or participate in a sexual act
Some cases of sexual assault do not include violence; neither do they leave physical injury. Sexual assault, in most cases, causes severe distress, emotional pain and other injuries that are not visible. They often take time for a victim to recover from; therefore, they are treated as seriously as physical attacks.
Weinstein purposely lured girls into his hotel room or office and asked them to perform sexual favours promising to advance their careers. He also coerced the girls into doing a thing or two against their will.
Company policies provide a safe working environment for all its employees that is free from discrimination at the workplace on any grounds that include sexual harassment. Companies also should operate a zero-tolerance policy for any form of sexual harassment in the workplace, treats these incidents seriously and investigate all cases of sexual harassment. Any person found guilty of performing the mentioned activities will face disciplinary action, up to and including dismissal from employment.
