Reasonable expectation of privacy
The decision to disclose information on sites such as Facebook and Instagram is informed by the decision to balance their needs- such as privacy and wellbeing and the kind of posters they need to put out. A utilitarian interpretation view informs information disclosure. This approach views privacy in terms of the dependent and independent variables. Independent variables are related to behaviors that include the willingness to share private data and information release habits. Dependent variables are informed by factors such as experience, consciousness, and personality.
Reasonable expectation of privacy are situations where there is a legal right to privacy and keeping your affairs from being known. However, when using the internet, in particular social media sites, reasonable expectation of privacy is diminished. Privacy expectation is subjective in the sense that an individual’s view informs it of the privacy of a specific location or situation. When using a public or work computers, a reasonable expectation of privacy is also minimal. For instance, what you do online can be monitored if you are at work, and the company can check what you are doing. However, if the device you are using is hacked, then you have a reason for privacy. However, is you are in a public place, and someone looks over your shoulder and checks what you are doing, there is little privacy expectation to privacy in that sense.
The right to enjoy privacy from intrusive governments and employers is guaranteed under the Fourth Amendment, and there is no exception or reason for the invasion of one’s privacy. Moreover, the constitution stipulates clearly places, situations, and areas where one does not expect to enjoy privacy. The law is never silent during times of war. However, it may occasionally permit deviations to legal norms applicable during times of peace. However, it is not expected that the government will trample on the basic human rights, but is entitled to restrict such rights as they may deem necessary.
