Same-sex marriage
The Supreme court, in its 2015 ruling, made same -ex marriage legal in all 50 states under the controversial decision Obergefell v. Hodges. Granted that no court case remains permanent, should the Supreme Court re-consider the ruling in light of opposition from some states, mostly in the South and Midwest? Is the decision regarding same-sex marriage the prerogative of the state governments or the national government?
Due to the numerous concerns that people from different countries have raised, the Supreme Court should reconsider its ruling on same sex marriage because the issue does not only affect social life but religious morals as well. The religious perspective points out that marriage should be between a man and a woman, therefore, rendering the Supreme Court decision void.
Is the decision regarding same-sex marriage the prerogative of the state governments or the national government?
The prerogative on decisions regarding same-sex marriage lies in the jurisdiction of the national government. The central government is in charge of making any legal decisions that affect all citizens and thus it is mandated to determine such issues that affect all people in the country (Cao et al., 2017). The discrimination is based on courts’ manifestation to protect religious freedoms. Same sex-marriage came into existence recently and thus not included in the religious teachings.
Is same-sex marriage an equal rights issue? Should the national government let states handle its legality or should the national government be in charge of it? Do you think the decision reached in favor of Jack Philip’s business directly contradicts the intent of Obergeffell V. Hodges (2015)?
Same sex marriage resulted from people who wanted to have equal marriage rights. However, the national government should exercise full control of the issue because such critical issues affect all people and thus should be handled by the national government (Pinsof, 2016). Jack Philip’s decision contradicts Obergeffell V. Hodges (2015) decision because Hodges championed for the rights of same sex couples. Jack argued that same sex marriage was unlawful from a religious background.
Why should there be a ban on same sex-marriage? Should the Supreme Court overturn Obergeffell V. Hodges (2015)?
Same sex marriage should be banned because it promotes moral decadence as well as contradicting religious teachings, and thus, the Supreme Court should overturn decision of Obergeffell V. Hodges (2015).
