The Federal Constitutional Laws

Introduction

Federalist NO. 10 is the tenth essay of the federalist papers written by James Madison. He was trying to argue out why ratification in the united states constitution. He advocated more on the reconciliation of citizens using their interests rather than those of others or that of a community at large. Federalist is all about the high need for power, whether at the national level or at a state or representative level that tends to cover for the direct governing of the people. In his essay, Maddison describes the role that factions play when it comes to democracy and how they negatively impact consent. A single faction would not be able to influence the large government the way Madison did. James used all means he could to display supremacy of the federal law to the people and advocated for an even stronger government.

Madison explains faction to be the opposing ideologies that lead to the formation of different political parties. For example, today, there are a lot of various political parties that have risen with their ideas apart from what the main political party governing the state has. He claims that factions are inevitable to humans since nature has it that people will have different opinions, wealth, properties, among others. People will always form alliances trying to fix a situation. They will do all they can to make these alliances work and become more reliable than other partnerships in the related field. They will also work against the interest of other people or the public to fulfill their desires. He, therefore, puts a question across on how to safeguard against these conflicting interests. It is possible to do away with these factions, which is destroying the liberty of the people, which is very hard to live without and equalizing everything to the citizens, that is, the same interests, same opinions, ideas, among others.

Critics followed him as the founding fathers of the great principles of democracy argued that Madison was more interested in a representative republic rather than factionalism and partisanship. According to him, it would be hard for the unworthy running candidates for elections to practice barbaric acts to the public. Here the public is not represented as it should be and will tend to follow the rules that have been set by the constitution. This makes Madison think that the existence of factions will reduce and destroy liberty for the people, especially those in power. Liberty is essential, and it would be hard for any political faction to succeed. After all, what was the essence of the American revolution war? Democracy is an idea that is used in running the government while a republic is a form of government that allows the government to be democratic. From his point of view, a republic is different from democracy as it tends to give the delegates the mandate to govern, thereby spreading it to a far much bigger area. This means that there will be a more vicious act that there would in a small republic. Madison argues out that a representative republic is the most effective form of leadership that a government should have. He also says that the constitution is a combination of the republic and democracy that put more effort into the state legislature even though it incorporates the national, local, and state legislatures. He claims that this brought about a decentralized governmental structure.

A republican government, just like the one in the United States, gives the people authority to choose what political candidates they want in the government. The basic principles that are in the US constitution engage the citizens a lot, therefore, making sure that they are not left behind in decision making. How stable the government is relying entirely on the people. There are a lot of advantages that come along with this type of constitution. Every law that is passed is for the good of everyone in the government as well as the citizens. Selfish interests with time kill the common welfare for the country. The laws made by the elected representatives by the people are fair. In a case where the laws are unfair, the people have the mandate to choose other leaders who can change the laws for the betterment of everyone. Also, a republic government gives freedom and prosperity to everyone. This is especially in the economic benefits of everyone, thereby good standards of living. The government, in this case, will be serving the welfare of the common citizens. If possible, nations should adopt the republic government as it advocates for fairness, collective well-being, and freedom.

Part 2

Changes in government decision making would have a lot of implications on the citizens, especially if they were not included in these decision making programs. Workers and laborers are one of those people who have been greatly affected by these decision-makers. Most politicians will require the support of the prominent members in the society. These politicians will, at times, make decisions that will affect business people if they do not get the help they require. If the representatives chosen by the people decide to take care of the people who elected them first, then there will be more fairness in the country. However, this is not mostly in the case. As a business person, there are a lot of governmental decisions that affect people profoundly. For example, imposing too high taxes, import duties, and tariffs on goods will profoundly affect the business and demand for products. These trade barriers tend to reduce the availability of goods but raise the price of these same goods. The result is that the business community gets low income, loss of jobs, and reduced economic output. Trade barriers lead to more financial harm than good. Even though the US has a high openness to trade, which contributes to its excellent economy, it still maintains some duties on several goods. For example, in the clothing and apparel sector and the footwear. The effective rates of these tariffs may seem low, but the actual effect depends on the category of goods. Tariffs are meant to promote trade of the local products. This is why the tariffs are higher than what you will find in the local markets. At times consumers might see it better to just by the goods locally rather than buying the imported ones since the prices will be abit higher. Tariffs will offer local industries some protection for some time but will not completely shield it from the competition; this is because there are consumers who still want to purchase the imported goods even with the high prices. When this happens, the consumer will lack enough money to spend on other locally manufactured goods, therefore, dropping one industry to join the other. It will lead to an uneven distribution of resources, slow economic growth, and even a stagnant economy. Tariffs are regressive and are therefore not affordable to lower-income consumers.

The government, since it is a republic government, should involve traders and business persons before imposing high tariffs as a way of protecting or promoting the local industries. They can come up with ways of balancing both sectors that are imports and local trade. By doing this, they will at least be able to protect those business persons that deal with imported goods. They will also protect that consumer who loves buying imported goods from any price exploitations. Also, coming up with non-biased timing for the increased tariffs. An onetime tariff increment per year would be better rather than increasing them from time to time. If the government does not look into some of these matters and implement them into the federal constitution as a law, it will be hard for any business person dealing with imports to excel. A republican government involves the citizens in its decision making; this is why there is a need to use these representatives when it comes to airing out issues, for example, in the import sector. If the tariffs are lowered, the business persons will import goods at a lower price and sell them to consumers at a lower price. This will promote equality and fairness to all.

Conclusion

Federalist 10 is a kind of citation that was used to show that the founding fathers of the constitution, did not necessarily advocate for a partisan government. Trying to restrain liberty would not be a good idea of limiting faction. The control of these factions is hard to do away with without interfering with American rights or liberties. However, the use of a representative for each state or region will help air out the ideas or opinions of other citizens so that they do not feel left out. There is equality for each opportunity that comes by for every American citizen. Also, the acquisition of property and wealth should be equalized to remove the many gaps there are in society. Equal treatment equals to the common welfare of everyone in living in the United States.
