The tenth amendment

  1. The tenth amendment ratified in 1971 states that the government posses powers delegated to it by the constitution, and the remaining powers are reserved for the people of the state. The privileges and immunity clause is also known as the Comity clause. It protects the citizens from discriminatory actions of the state.
  2. Checks and balances enabled to limit the powers of the arms of governments. An example of checks and balances is the law-making process. The legislature cannot exercise its powers to make laws that will favor them; this is because before the laws can be enforced, it passes through the judiciary and the executive.
  3. Commerce law is a branch of civil law. Commerce law guide rights, conduct and relations between people and businesses involved in merchandising, trade, sales, and commerce. Commercial law governs the sale of goods and services security interests, negotiable instruments, and principle- agents contracts. A farmer selling goods in the country where the farm is located can be sued under commerce law. This because the contract between the buyer and the seller has the offer, acceptance, and consideration.
  4. The federal Controlled Substance Act regulates the manufacture, possession, use, distribution, and importation of certain substances. Under the Comprehensive Drug Abuse Prevention and Control Act control the legalization of marijuana. For decisions to be made, the potential for abuse will be considered.
  5. The dormant commerce clause relies on the restriction on state power to act. Implied preemption the state law will be impliedly preempted if state that if federal law conflict with state law.
  6. The supremacy clause state that federal laws and constitution take precedence over the state constitution and the state law. It limits interference of the federal government and allows it to review state laws. Federal preemption enables federal law to display state law because of its given power under the supremacy clause. Congress has the power to place and collect taxes, impost, and excise, provide common defense and pay debt.
