Response to Legal and Ethical Principles in Nursing Practice

Post 1 response

Once you hear about medical or nursing ethics in a health care setting would sound just easy although there are specific ethical issues that do arise as a result of the sensitive nature of handling the lives of people. Health care providers are expected to abide by the laws and a code of ethics which govern how they behave. These ethics are associated with moral principles and actions. There is a significant view presented on this post that nurses are obliged to give respect to the decisions and wishes of the patients irrespective of whether they like them or not. It would be essential to concur with the idea that health care specialists should have the responsibility to give advice or suggestions to the patients. However, any actions that may be taken to persuade the patients to make a decision would be a violation of the autonomy principle. Also, it is right to say that the health care professionals need to practice to do good or doing that is best to ensure care to the patients. The duty for the nurses is to ensure that the patients get the best treatment that they deserve for them to gain their health. Therefore, nurses need to develop and retain the best level of skills and knowledge. Generally, all the methods and treatments that are recommended must be planned to do the best for the patient.

Nurses have been governed by some legal laws which ensure that they deliver the safest care to the patients. The legal principles indeed protect patients and the nurses from the liability. I fully support the application of the standards of care as one of the legal principles where guidelines and procedures of how the nurses should work are entailed. In every organization, there are set procedures which nurses have to adhere to failure to which results in violations of the laws. Through the principle of public health laws, the health care settings and the nurses should ensure community health and advocate people’s rights.

In response to the legal principles of nursing practice, I support the idea that these principles have been of great importance to the nurses and the patients as well in ensuring delivery of care and protection of the patient’s information. The instance is given of the legal principles such as the Health Insurance Portability and Accountability Act. In this act, it is stated that a patient must be aware of whoever is accessing his or her records containing the health information. It is of great importance to ensure that the patient’s health records are not disclosed to any other person behind the knowledge of the patient. This act provides the rights of the patient are protected from unauthorized users.

It would be so embarrassing for the patient to find out that his or her information has been disclosed to other people. Therefore, it should be guaranteed that health records should be private and confidential. There are occasions when a patient health data may be disclosed through the use of media such as if the patient gives permission even though the Health Information Technology for Economic and Clinical Health Act (HITECH) states that patient’s information should not be let out via social media. The primary idea here is ensuring that the patient health information is left for him or herself or any other person permitted by the patient.

The healthcare specialists are urged to help the public in times of emergency but are not allowed to act outside their scope of practice according to the law of good Samaritan. It is an idea that can be fully supported that the nurses to work within their scope of practice.

Generally, ethics principles describe how the nurses are supposed to behave in the hospital setting to ensure that right healthcare is delivered to the patients. On the other side, the legal principles describe the guidelines which need to be adhered to by the nurses in ensuring that they provide the right services to facilitate the improvement of the health of the patients. Therefore, all nurses and the entire staff in the healthcare setting need to concur with the set laws and uphold their responsibilities.
