Case Name: Brown v. Board of Education

Issue: Oliver Brown’s daughter missed an admission because of her skin color in a public school in Topeka, Kansas. The school was next to their resident home, Brown’s daughter was forced to find admission in a school far away from their home that accepted black student. This incident angered Brown and other black families that events similar incidents and their filed lawsuits action lawsuit in federal courts in the United States against the Topeka Board of Education. Brown and other families argued that segregation was against the law and was the policy was unconstitutional.
Constitutional Amendment: According to Oliver Brown and other colleagues were against the segregation of schools for the whites and the blacks. Brown claimed that the schools for the whites and the blacks were not equal, and this violated equal clause contained in the 14th amendment. The clause, according to the applicant, stated, “No state should deny individuals within its jurisdiction equal protection laws as conveyed by the amendment.”
Procedural History: The case had not been heard in any court in the United States since Brown filed it after failing admission for the daughter. The case was trying to counter the Supreme Court ruling of 1896 that allowed racial segregation for public facilities. The Jim Crow laws “separate but equal” allowed barring African Americans from sharing public facilities with the whites.
Supreme Court Holding: The Supreme Court, after many hearing, found that school segregation deprived the blacks the right to equal protection that was guaranteed by the 14th amendment. The ruling did not offer a solution for desegregating public schools; instead, it created the second opinion on whether public facilities.

I agree with the ruling of Justice Warren that school segregation deprived blacks of the freedom of equal protection. !4th Amendment created protection for every person in the jurisdiction of the American States. Many Black Americans facing racial discrimination from the whites saw this amendment as a relief. Blacks were denied many rights, including the right to education and other fundamental rights that were only left for the white people. The separate but equal ruling of the Supreme Court in 1896 that allowed segregation was against unconstitutional since this gave room for black people to be mistreated by the white who felt superior and wanted to make the blacks feel inferior.
According to the article in The New Yorker titled “Did Brown Matter,” the author says applauds Justice Warren’s ruling saying that the verdict gave rise to other movements that advocated for equal rights among the blacks and the whites. The authorities at that time were discriminating against the black people who were facing unlawful arrests and denied access to some areas that were only restricted to whites only. The civil rights movement grew in 1955, led by Martin Luther King Jnr advocating for a peaceful method of resistance. The movements were to enable desegregation in public places and end racial discrimination.
The case did not overrule the previous ruling; instead, it gave a clear outline that public segregation was unconstitutional since it violated constitutional amendment. The 14th amendment that advocated for equal right among the citizens in all States barring all discrimination to non-whites in all American states.
