DUTIES, RESPONSIBILITIES AND RIGHTS OF A PROVIDER AND THE PROVIDERS’ PATIENT UNDER THE EMTALA AND HIPAA STATUTES EMTALA was enacted in 1986 by the United States Congress as a section of the COBRA, which deals with the Medicare matters. The prime purpose of the law or the Act was to ensure that patients have right of entry to emergency health services as well as stop the practice of patient abandoning, where the patients who are uninsured are moved from private health facilities to community health facilities because of the financial reasons. The law (EMTALA) is one of the most inclusive laws assuring nondiscriminatory access to emergency medical service and the system of the health care. [1]This law applies to nearly all elements of patient care in the hospital environment. On the other hand, HIPAA was passed in 1996 with a mandate of making sure that the Secretary of Department of Health and Human Service publicizes standards for security, privacy, and electronic transfer of health information. [2]HIPAA ensures that the health care provider is a covered entity, the one who…
Hate Crime Laws Hate crime laws have been created to curb the occurrence of hate crimes against marginalized communities and special groups. Hate crimes are becoming a significant problem and issues continue to arise regarding the application of these laws. Current laws permit for the prosecution of hate crime based on the individual characteristics of an individual. Though hate crime laws have an essential role to play, there are complexities concerning these laws that have to be addressed. There are negative attitudes towards hate crime laws from large sections of the society, and this is an issue that needs to be addressed. One major issue in question is the fact that there are questions as to whether hate crimes can be distinguished from other crimes. Some sectors have called for the prosecution of hate crimes at community or state level. Furthermore, there is a common belief that the media exaggerates the occurrence of hate crimes (Lieberman). It is also important to consider that the USA has experienced a significant social change in the last few decades. There are many factors…
Operant extinction Operant extinction refers to the elimination or suppression of previously desirable behavior by eliminating the stimuli that facilitated the occurrence of behavior (Lattal & Lattal, 2012). An excellent example of a behavioral aspect that I had previously exhibited and consciously suppressed was picking my nose using my fingers. Even though I cannot trace how I started the habit, I know that I used to associate it with clearing my nose and respiratory system as a whole. However, after joining Middle School, I quickly realized that the nose-picking habit was undesirable and even downright disgusting to some of my classmates. Since I did not want to run the risk of attaining a nickname coined from the behavior, I quickly resolved to stop it and succeeded after a period of two months. Describe how the extinction contingency played a role in the discontinuation of this behavior. The extinction contingency was critical in defining the start and the progress of stopping my nose-picking habit. This was possible since the positive stimulus of clearing my nose using my fingers that reinforced the…
Austerity is the only Game in Town Introduction Pension reforms are targeted at improving the way governments in Europe respond to the need to maximise the well-being of its ageing and working populations, reduce uncertainties through establishments of National Insurance Acts and prevent the risks of poverty among the ageing population after retirement (Barr & Diamond, 2006, p. 5). Pension reforms are also important to governments that realise the significance of having a minimal disparity between the low income and high income earners after the retirement age. The United Kingdom’s population is ageing, hence the need for the governments to adopt political, social and economic changes that are often caused by dependence of the ageing on the working population. Austerity measures are taken by the political system to ensure that the government does not incur high expenditure in payments of pension. The rapidly ageing trend in the UK is caused by various factors, among them declining fertility rates where women in the current generation have fewer number of children as compared to the past generations (Trades Union Congress, 2013, p. 12). Improvement…
Advocacy of climate change and children’s rights Climate change is progressively being surrounded as a significant human right apprehension. Associations conducting societal campaigns about the social components of environmental change are looking at human rights systems and apparatuses to hold state entertainers, the universal network and private on-screen characters to account. In many developing countries, children hold the least obligation regarding environmental change yet will acquire the effects alongside the heritage of an environmental change system that presently can’t seem to make genuine progress towards handling the issue (Cocco & Mauger, 2018). It is accordingly time to take a gander at the significance of the Child Rights Regime. This resource explores the issue of climate change and the ways in which this change links with children rights. I have provided a general overview of climate change to create a good understanding of the phenomenon and the knowledge that is needed to engage children as actors of change. A 2014 review by IPCC, the intergovernmental panel on climate change documented the effects of global warming and its effects to human…
My position regarding academic integrity My position regarding academic integrity is that cheating is not acceptable and should be not be condoned in learning institutions. In this light, students who engage in deception tend to overlook their potential and develop a notion that cheating is the only way in which people can succeed in life. There are many reasons why I argue that cheating is unacceptable in learning institutions. First, cheating goes against ethical principles, which are the foundation of human behaviors. In this light, cheating violates the policy of honesty and integrity. Secondly, People who cheat in the exam also don’t perform well in the respective examination due to the panic and tension. The fear of being caught and the consequences may not allow them to engage their mind and realize the best properly. Third, cheating is not acceptable since it helps brew the character of corruption and extortion. People who cheat in exams later become very corrupt and violate social morals since they always believe in short cuts to achieve their dreams. Among other reasons, I greatly feel…
stakeholders that help support CAPTA and how to garner their support Child Abuse Prevention and Treatment Act (CAPTA) is a law that provides room for financial assistance for programs that are focused on identifying, preventing, and treating child neglect and abuse. The bill also deals with identifying federal roles concerned with providing data collection services, technical assistance, and evaluation activities related to child neglect and abuse. To addressing this law, it is essential to have the support of key decision-makers and other significant stakeholders. This paper aims at discussing stakeholders that help support CAPTA and how to garner their support. The first essential element in undertaking any project is to identify all the stakeholders that might be interested in the project. In my plan, I would first make a list of all the stakeholders that share my interest in getting involved in CAPTA. At this stage, it is crucial to understand what motivates the various stakeholders because it makes it easier to garner their support. It is easier to approach organizations and individuals who are interested in a particular field…
Improving Maternal Morbidity and Mortality Rates Introduction Quality of care is an integral component of equity, dignity, and the right to medical care to children and women. As nurses, it is our mandate to make sure that all patients get quality care without discrimination or prejudice. In 2016, the World Health Organization (WHO) published standards to be adopted by healthcare facilities in improving maternal and newborn care (World Health Organization, 2017). The standards emphasize the significance of nurses in improving care and patient satisfaction due to improved healthcare outcomes. Clinical Problem My measurable patient-centred practice problem involves an increased number of maternal complications, care of sick newborns cases and mortality rates reported in the within our health facility. Most of the cases are usually from our internal maternity department, while very few are referred from other facilities. Despite the increased global coverage on reducing stillbirths, maternal and newborn mortality, and afterbirth complications to mothers and newborns, it seems we still have some inadequacies in our maternity or ER department. Such shortcomings lead to increased levels of the reported cases of…
Globalization and Identity Introduction Neoliberalism is a new form of Adam’s Smith’s liberalism idea that countries should practice tariff-free and barrier-free global trade and investment (Kottak & Kozaitis, 2012). Neoliberalism can be traced back to the 1930s in the US during New Deal under President Franklin Roosevelt. Globalization entails linking countries and people across the world through political, economic, transport, and modern media (Kottak & Kozaitis, 2012). Notably, globalization facilitates the mass media socio-cultural impact process in which people reside in global villages; that is, they live in transnational and multilocal lifestyles. According to John Maynard Keynes, the economy should operate in full employment to facilitate the growth of capitalism (Kottak & Kozaitis, 2012). Where necessary, the government and central bank should intervene to increase or sustain the level of full employment. In line with Kottak and Kozaitis’s (2012) definition, Cyberspace is an intangible or psychological space that includes and limited to social media, videos, text messages, and email. As an extension of personal or collective minds, cyberspace determines how people react to different milieus. Multinationals are companies that operate…
Addressing the Gender Divide in Digital Labour Gender equality is not only a fundamental right, but it also provides opportunities for economic development. The “demand economy” or the “gig economy” is now intricately intertwined with the traditional economic structure (Van Doorn, 2017). With the transforming world of the internet and digital platforms, new avenues are opening up for women to contribute to the world of digital labour. Through the digital space, women have the opportunity to earn additional income and access new information and knowledge. Moreover, the digital world provides a welcome avenue to bridge the much talked about gap among the genders. Photo: Both genders contribute immensely to the economy, highlighting the importance of gender equality. The road ahead to gender equality in digital labour remains difficult. Data from the OECD (2018) illustrates that over three million more men exist in digital labour more than women worldwide. Furthermore, the ICT sector underemployed women, with similar discrimination occurring when comparing the number of women and men who own startups. This damning data confirms the asymmetrical distribution of the male…
