changes that have affected the established principles of contract since the time of Investors Compensation Scheme v West Bromwich Building Society Abstract The paper is an in-depth analysis of various changes that have affected the established principles of contract since the time of Investors Compensation Scheme v West Bromwich Building Society through an extensive review of the existing literature. The first change was on the second principle of contract which stated that in contract cases with clear and unambiguous words, the face value of the language used in the agreement was the real meaning of the words in the contract. Another change was on the third principle in which the jury abolished the law that excluded the use of pre-contractual bargains to assist in establishing the meaning of a contract during a courts hearing. The fourth principle of the contract was also changed, and the jury accepted the use of valid evidence that confirmed both parties agreed on particular meaning to a word that had more than one meaning to establishing estoppel and not special meaning. Finally, in the fifth…
The courts and administrative structures are founded on the law The courts and administrative structures are founded on the law that has been in existence for centuries. The rule holds that criminal liability is significantly dependent on a person’s capacity for moral judgment, which is not very distant from what is considered legal. A person’s moral capacity is used to determine an individual’s culpability to comprehend and choose between right and wrong. It is for this reason that the insane cannot be charged for the lack of moral judgment because they lack understanding. This law has been held in over forty jurisdictions, but Kansas does not consider moral capacity when making decisions in its criminal code (Garrett, American Justice 2014). Instead, the state applies a more modern interpretation of morality knows as the men rea, which is a strategy used to eliminate the means previously used to assess whether a defendant possessed the mental intention to commit a crime. The argument we intend to make using different mechanisms is to show that Mr. Kahler’s judgment was not intact and was…
Drama has always been taken as an objective and impersonal representation of life Drama has always been taken as an objective and impersonal representation of life. It narrates the events that are taking place off the stage and makes comments on the morality of the actions presented in the scene. Precisely, drama forms the basis of social criticism, which has been regarded as the most crucial function of all art. Many scholars have depicted that apart from imitating actions in society, drama constitutes a powerful tool through which social conditions are determined. For instance, in “a Doll’s House,” Ibsen refers to puppets, playthings, and dolls all over the play to expose the constrained roles of women in his society and the tribulations that arise from an extreme imbalance of power between women and men in society as illustrated below. The references are used to signify the conservative view of women’s roles by men, particularly in motherhood and marriage. It is clear from the play that Torvald perceives the sacred duty of a woman as being a good mother and wife.…

bylaws which establish minimum separation distance (MSD) There are particular bylaws which establish minimum separation distance (MSD), which prevent setting up of housing for psychiatric survivors. For example, municipalities in Ontario still enact bylaws for zoning, which restrict the housing for the psychiatric survivors (LeFrançois , Robert, and Geoffrey, p.225). Such enactments and law are likely to make psychiatric survivors feel not cared for and lack the reason for living in a society that cannot allow them to build a shelter to reside in. Such feelings and treatment can make some survivors suicidal, especially those who have no relatives to hold their backs, host, and support them. They feel like outcasts since society fails to treat them as ordinary people. When there is emotional proximity between psychiatric survivors, that is not considered to be integration. Sometimes, psychiatric survivors are discouraged from relating amongst themselves. For instance, in patients who are in hospitals are usually denied permission to visit their friends in the ward the moment they are discharged (LeFrançois, Robert, and Geoffrey, p. 229). Restrictions such as these would make…
The rights in the bill of rights The rights in the bill of rights ensure citizens have the freedom and shield them from any form of inappropriate government action. The Bill of Rights assured a private domain of personal liberty without government limitations. However, no amendment apart from the first one protects the citizens against the national government. Barron v. Baltimore established a dual citizenship concept arguing that people were citizens of both national and state governments separately, meaning that the bill did not apply to the states. (“Chapter 8: The Federal Courts | American Government, Brief 12E: W. W. Norton Studyspace”) The 14th Amendment emphasised that states were limited to develop any laws that deprive the liberty of citizens of the US. Also, no state was allowed to deny any person prosperity or wellbeing without following legal procedures. However, the supreme court proceeded with its application approach of dual citizenship, promoting selectiveness, and the Bill of Rights was incorporated into the 14th amendment selectively per case. During the 1960s, a good number of rights, such as rights concerning privacy,…

Housing developments among the Aboriginals Housing developments among the Aboriginals are dependent on their cultural perspectives. Aboriginals have been improving on their building techniques that give way to proper housing. However, architects who are not aboriginals have been taking credit for the work by the Aboriginals architects. This leads to the problems of the authenticity of the owner of the built environment. Kevin O’Brien discusses the architectural practice of Merrima in determining the identity and representation in architectural work (O’Brien, 2016). Cultural protocol has been acknowledged in the analysis of the merrima architectural work. The merrima project helps to give credit to the Aboriginals’ contribution to the built environment. Cultural aspects of Aboriginals have been defined in the merrima project (O’Brien, 2015). Also, the architectural semiotics in the project is a show of proof that Aboriginals own the work. Merrima project has expressions of the social-political environments from local to national levels (O’Brien, 2015). However, with the merrima project being built environment for the Aboriginals, there are obstructions from the non-Aboriginals architects and reviews. A dialogue of representation and imagination…
