Society without a State

Society concerns an organization or association of people who end up cooperating and behaving with one another while living in the same place with similar interests under established laws. This may be summarized as an organized group that is controlled by specific strict statutes and norms (Micheletti, 2019). Society would only be in a “state of nature” or prosperous or free whenever every individual gets protected from the force that others impose through the rule of law. The state is there to make and enforce laws. If there is no state, then it means there are no established laws. Consequently, a society with no laws is one that is not in a “state of nature” or is in chaos.

A state that lacks laws, and hence the government would be in anarchy. Through definition, anarchy concerns the state of disorder because of the lack of or recognition of a figure in authority. In the real sense, if there is life without some rules that control people, it means there is disorder (Zaslavsky, 2016). People are human, and by the nature of humans, there is an exhibition of flaws. In case that the defects do not become controlled in a certain way, they may likely cause havoc upon an individual and the people around them. There will be a tendency for people to do as they please if laws are not there. There will be rampant cases of murder, cruelty, rape as well as harsh life that would only ensure that juts the strong survive. The weaker elements in the society who may likely not survive in a free state may end up diminishing as their rights will not be protected. There will not be any form of justice in such a kind of society.

Law is defined as circumstantially concerns with some system of rules that are mostly enforced through established institutions (Robson, 2018). It ends up giving shape to economics, politics, and society in many ways and serves as the central social mediator in the relationships that people have. There exist various kinds of laws that are concerned with various matters with varied functions. However, all the requirements of a given state become embedded within its constitution (Tainter, 2017). Therefore, constitutional law presents the framework for law creation, protection of the rights of individuals, and the election of people to represent the citizens in many seats.

The established legal systems highlight the responsibilities and rights of individuals in many ways. There may be a general distinction made between standard law systems, where the laws made by judges are not consolidated and civil law jurisdictions, that end up codifying laws. In individual nations, religion is responsible for the law (Micheletti, 2019). Law offers some reliable source of scholarly exploration like legal history as well as a philosophy or even perspectives of science like economic analysis or sociology of law. The perceived study of law brings into fore significant as well as complex matters related to fairness, equality, justice, and liberty.

Within established democracies, the major institutions that are responsible for interpreting and also creating laws are the three arms of government: the judiciary, legislature, and an executive that is accountable enough (Robson, 2018). Therefore, the implementation, along with enforcement of laws, are central functions of a state. Further, the police and the military have to be there to implement and even enforce these laws. Much as the organs of the country are created through the laws of the land, the presence of an independent legal sphere, as well as a vibrant society, ends up supporting their well-being.

The robust aspect of law concerns its philosophy, which is mostly called jurisprudence. Political philosophy is concerned with normative jurisprudence and gets to ask what law should be. On the other hand, analytical jurisprudence gets to ask what the law is. The law concerns the commands that are supported by sanction threats from some sovereign power that people obey (Micheletti, 2019). This concept of natural law came into being during the ancient Greek times and in their philosophy. It came together with the idea of justice and was embedded by Thoma Aquinas in his writings in Western Culture.

In the past, there were such attempts aimed at creating anarchist societies. Some notable examples include Catalonia from 1936 to 1939, Jamaica in 1720, and Ukraine from 1918 to 1921 (Robson, 2018).  In particular, in 1918, in the course of the Ukrainian revolution, attempts of coming up with stateless anarchist society led to the establishment of “Free Territory.” Nevertheless, the formation of these anarchist societies has been quite hard, and they have not been successful over time because of the internal as well as external forces. For instance, neighboring states have mostly crushed these well-organized societies that are operating in anarchy (Tainter, 2017). This mostly happens because of the fear of natural resources and power. In some other cases, an anarchist society can crumble from within like happened in Albania in 1997. In the case of Albania, there was the formation of an anarchist state because of the collapse of the state, and this ended up boosting the influence of criminal gangs.

Conclusion

As human societies went on to evolve, there was a need for codified rules as well as regulations that were much felt across many places. As the societies turned more complex and the relations among humans and their interaction went on to be more regular and usual, there was a requirement to make a difference between whatever is wrong or right. There was a need to control the various human attitudes and interactions so that they would become more civilized. Further, they had to be kept on track to bring about the right well-being of the larger society. Much as people have never been so successful at their various designs, there has been some little success at the display of creativity and wisdom in this area. The design of laws has been one of the very significant aspects of the political and social life of humans to control human attitudes to promote co-existence. Religion has served as one of the sources of law for the creation of states. Without a state, a society may not descend to a “state of nature.”
