Three Strikes Law
The three-strikes law was implemented in the United States in 1994. It was made to punish those who are known to commit habitual crimes in the United States. It states that If one is convicted for violent crimes or felonies, they are supposed to be sentenced to life imprisonment if they are caught the third time. The main aim of the law is to protect the community from the habitual people who commit crimes continually. Many states have accepted the law, such as in Kansas. The people who are found to have committed the two crimes are referred to as persistent offenders. This paper is a discussion of the three-strikes law in relation to the Habert Packer’s Crime Control Model and the due process model. It also discusses the packages that the police take to help the people who have an addiction to drugs and other social evils such as gambling.
Habert Packer came up with ideas about how the law should be implemented in the United States. In his argument, two significant ideas were expressed. The first one was the crime control method. In his opinion, he suggested that crime control methods are based on the protection of the community from violent criminals. In this idea, he seemed to support the three-strikes law. The best way to protect the community from violent criminals is by ensuring that the people who habitually break the law are punished and locked away in prisons where they no longer pose threats to the community. When one bases their perspective on this theory, the three-strikes law is ethical, and the main aim of crime control is achieved by protecting the community from the habitual criminals.
The second perspective is the sue perspective model. The idea seems to favor the alleged criminals. It appears to support the rights of the criminals by following the concept of innocent until proven guilty. The policy does not advocate for the locking away of criminals but instead asks that they are rehabilitated instead of having them locked away. It is easier for the people to be taken to rehabilitation centers instead of locking them up in state prisons. It reduces the overall budget for the nation and also reduces the chances of falling back into crime. In this idea, the people in prisons are supposed to be taught practical skills that they can use once they are out of jail instead of reverting to their old lives. If the policy is applied and the person still goes back to crime, then the three strikes law is ethical if implemented on the person. Three chances with rehabilitation training should be enough to assume that the criminal cannot change despite the opportunities given to them.
There are several measures that the police use to help those with addiction problems such as alcohol and gambling. The first one includes a rehabilitative section of police officers who can help the non-violent drug addicts. Lockin such people away does not help them in any way, but helping them change their behavior helps in changing them. Some of the addicts are also willing to change, and therefore, the police force uses that leverage and corrects them to fit in the society again. The second means is by smart prohibition, whereby the government does not base their judgment on drug use but rather on the actions that people do under the influence or to get the drugs. Smart legalization is also applied, whereby only nonprofit organizations are allowed to sell drugs. In this case, there are few cases of people who will venture into the business, which reduces the addition rates. Drug abuse is a negative impact In the United States and should be controlled by all means.
