Why Martinez Should Not Be Released but Punished

Tony C. Martinez, who has been in custody being accused of murdering a 39-year-old woman in the presence of her children, should continue to be held awaiting conviction and later serve a term. Martinez, who is convicted of first-degree murder, is guilty and deserves to be punished in line with the criminal and retribution system.  I believe that guilty people deserve to be punished proportionally to their crimes. Martinez, therefore, deserves to remain locked up and punished for his atrocious crime and violent conduct. Evaluation of the murder shows that the victim was defenseless and unprotected during the crime, and the evidence directly points to the accused. It proves beyond the reasonable doubt of his guilt. The imposition of an appropriate punishment will be a great response to the cry for justice for the vulnerable children. Being present at the time of the murder, the children were subjected to emotional and psychological suffering. His release triggers the feeling of insecurity they experienced in the hands of the criminal. Such an encounter will force them to relive their worst moments. Given his tendency towards violence as indicated by the previous history, such as the issued warrant for domestic violence. Martinez is likely to threaten the welfare of the children, as indicated by his violent behavior..

The criminal should be subjected to painful, humiliating punishment as a way of deterrence and lesson to potential offenders. Releasing Martinez without penalty increases his likelihood of committing other crimes and especially causing harm to the children. No one has a right to take another person’s life, Martinez, therefore, remains unsafe not only to the children but also the society as he is endangering the lives of other people. Martinez should not be allowed to get away with what he did. What kind of justice will that be? He deserves to be punished and isolated from the world.
