In the case of Erie R. Co. v Tompkins 304 U.S. 64. (1938), the holding and reasoning state that since the federal common law is considered invalid. It was determined that the federal courts that sit within the diversity of their jurisdiction need to apply substantive state of the law as well as federal procedural law. This cannot only take place when there is a conflict that exists between the functional state and federal law.
