Problems Faced by courts today.
Courts are the most common channels of getting justice in the world at large. They are depended upon by many organizations, parastatals, and individuals. Many people have used the courts to gain their interests and also have influenced the verdicts given. Therefore, courts have many problems that are affecting their service delivery. This paper will discuss the difficulties courts are facing and proposed solutions to the same.
Corruption, among other vices, has influenced the credibility of the courts. Some parties always have the mindset that they can never lose a case in court. Hence, they do anything possible to win, and corruption becomes an option for them. The ethics of the judges is a big challenge. Unethical judges are corrupt, nepotistic, and even tribalistic. By doing this, justice in courts is denied. Political influence whereby judges may make speeches for civic organizations or show political interests is a challenge in courts. The solution to the above difficulties is strict rules among the judges. Corruption cases should be capital crimes, and severe punishment should be granted.
Many cases are occurring, and Atkins v.Virginia(2002) is one of the typical examples.It involves Atkins and William Jones, who abducted Erick Nesbitt and robbed all the money he had, and they killed him. Both Atkins and William were arrested and accepted that they were guilty of the crime done. In the investigations, one forensic psychologist concluded that Atkins was mentally disabled based on his IQ low score. However, the court sentenced a death sentence to Autkin. Occurred since it cannot. It concluded that people who are mentally retarded are not involved in crime.
The case had a positive impact on the Criminal Justice System since it was a matter discussed by several courts. The discussion taught the power of detailed investigations in a case and not depending on one source of investigators in gathering evidence. I agree with the verdict given by the judge due to the flow of the criminal acts by the accused. Atkins and Williams stole the money Erick had and also the one in the Automated Teller Machine. This clearly shows the actions done were planned and intentional.
